1. General Terms

By using this Website, you confirm that you have reached the age of majority in your jurisdiction, or that you have obtained permission from your parent or legal guardian where required by applicable law.

You agree not to use our Website, products, digital content, tutorials, or services for any unlawful or unauthorized purpose.

We reserve the right to refuse service, cancel orders, restrict access, or terminate accounts where reasonably necessary, including in cases of suspected fraud, abuse, violation of these Terms, or unlawful activity.

Product colors, dimensions, appearance, and other characteristics may vary slightly from photographs because of lighting, screen settings, manufacturing processes, natural material variations, or the handmade nature of certain products.

We make reasonable efforts to ensure that product descriptions and photographs are accurate.

3. Pricing and Payment

Prices are displayed on the Website in the currency indicated at checkout.

We reserve the right to change product prices, promotional offers, subscription prices, and availability at any time. Any price change will not affect an order that has already been completed unless otherwise permitted by applicable law.

Customers are responsible for reviewing the total price, shipping charges, taxes, and other applicable charges before completing payment.

Payments are processed through payment providers available through our Website. We do not directly store complete payment card information where payment information is processed by third-party payment providers.

4. Orders and Order Acceptance

After you place an order, you may receive an order confirmation by email. Receipt of an automated confirmation does not necessarily constitute final acceptance of an order.

We reserve the right to refuse or cancel an order where reasonably necessary, including where:

• A product is unavailable;
• Pricing or product information contains an obvious error;
• Payment cannot be successfully processed;
• Fraudulent or unauthorized activity is suspected; or
• We are unable to fulfil the order for legitimate operational or legal reasons.

If we cancel a paid order, the applicable amount will be refunded in accordance with the original payment method and applicable payment-provider procedures.

5. Shipping and Delivery

Physical products may be shipped internationally from our designated fulfilment locations.

Shipping times shown on the Website are estimates and may vary depending on destination, customs clearance, carrier operations, local postal services, weather, public holidays, or other circumstances beyond our reasonable control.

Customers are responsible for providing a complete and accurate delivery address.

Where permitted by applicable law, additional customs duties, import taxes, VAT, brokerage charges, or other charges imposed by the destination country or region are the responsibility of the customer unless expressly stated otherwise at checkout.

6. Returns, Refunds and Cancellations

Returns, exchanges, refunds, and cancellations are subject to our Refund Policy and applicable consumer protection laws.

Eligible jewelry-making supplies, findings, components, wire, and other DIY materials may be returned in accordance with the conditions and return period specified in our Refund Policy.

Due to the handmade nature of our finished wire crochet jewelry, handmade wire crochet finished products are generally not eligible for return or exchange due to change of mind, personal preference, or minor variations inherent in handmade craftsmanship.

This does not affect customers' rights where an item arrives damaged, defective, materially different from the item ordered, or where an incorrect item has been supplied.

Digital tutorials, video content, and VIP membership access are generally non-refundable once access has been provided or used, except where required by applicable law.

Customers should review our Refund Policy and, where applicable, our Purchase Options Cancellation Policy before purchasing.

Nothing in these Terms is intended to exclude or restrict any consumer rights that cannot lawfully be excluded or restricted under applicable law.

7. Digital Products and Tutorial Content

Certain products offered by Michelle ML consist of digital content, educational materials, online tutorial videos, instructional demonstrations, photographs, graphics, written instructions, designs, and other educational or creative materials (“Digital Content”).

Digital Content may be delivered through restricted webpages, video-hosting platforms, customer accounts, membership areas, subscription services, or other electronic methods.

Access to restricted Digital Content is provided solely to the purchaser or authorized account holder unless expressly stated otherwise.

Digital Content, including VIP tutorial content, is provided for the purchaser's personal learning use only, unless Michelle ML expressly provides different written usage terms.

Purchasing or obtaining access to Digital Content does not transfer ownership of the Digital Content or any associated intellectual property rights to the customer.

Unless expressly authorized in writing by Michelle ML, you must not:

• Download Digital Content where downloading is not expressly permitted;
• Copy or reproduce tutorial videos, instructional materials, photographs, graphics, or other protected content;
• Record, screen-record, capture, or otherwise make unauthorized copies of restricted content;
• Redistribute, share, resell, sublicense, publish, republish, upload, transmit, or otherwise make protected content available to another person or the public;
• Share membership credentials, customer accounts, restricted webpages, access links, or other means of accessing VIP Content with unauthorized persons;
• Use Michelle ML content to create or distribute substantially reproduced instructional materials or unauthorized copies of the original tutorials;
• Use artificial intelligence (AI), generative AI, video editing, image processing, voice replacement, cropping, filtering, re-editing, or other technological methods to alter, disguise, reconstruct, or create unauthorized versions derived from copied or recorded tutorial content for republication, redistribution, resale, or other unauthorized use;
• Remove, obscure, alter, replace, or conceal Michelle ML branding, copyright notices, watermarks, logos, or other source-identifying information for the purpose of unauthorized republication, redistribution, or presenting protected content as originating from another source; or
• Use VIP tutorial content, whether in its original or modified form, to create unauthorized copies or substantially reproduced versions for publication, distribution, resale, or commercial exploitation.

Modification, transformation, editing, processing, or technological alteration of an unauthorized copy does not by itself create authorization from Michelle ML to reproduce, publish, redistribute, sell, or otherwise exploit the underlying protected content.

8. VIP Membership and Subscriptions

Michelle ML may offer subscription-based VIP membership providing access to selected tutorial videos, educational content, or membership benefits.

By purchasing a recurring subscription, you authorize the applicable payment provider to charge the subscription fee according to the billing frequency displayed at checkout until the subscription is cancelled.

The applicable subscription price, billing frequency, introductory pricing (if any), and other material subscription conditions will be displayed on the relevant product page or checkout page.

Where an introductory or promotional subscription price applies only to an initial billing period, subsequent billing periods may be charged at the regular subscription price disclosed when the subscription is purchased.

Customers are responsible for cancelling subscriptions before the next billing date if they do not wish the subscription to renew, subject to applicable law and the cancellation options made available through the Website.

Cancellation normally prevents future renewal charges but does not automatically entitle the customer to a refund for a billing period that has already begun, except where required by applicable law or expressly provided in our Refund Policy.

VIP Access Period and Membership Status

VIP membership access is personal and non-transferable.

Access to VIP Content is available only during the applicable membership access period and is subject to the customer's subscription status, these Terms, and any applicable mandatory consumer rights.

Cancellation of a recurring subscription prevents future renewals but does not, by itself, create a new billing period or extend the current membership access period.

Subject to applicable law and these Terms, where continued access is provided under the applicable subscription arrangement, a customer who cancels may retain access through the applicable already-paid membership period.

Customers who cancel should not assume that cancellation creates any additional period of access beyond the period already applicable to the subscription.

If a recurring payment fails, we or our subscription and payment service providers may attempt to recover the payment in accordance with the applicable payment-recovery procedures.

If payment cannot be successfully collected, VIP access may be restricted, paused, suspended, or terminated in accordance with the resulting subscription status, these Terms, and applicable law.

Membership access may also be restricted, suspended, or terminated where VIP Content or membership access is used in material violation of these Terms.

Cancellation of a subscription does not authorize the customer to retain, reproduce, redistribute, republish, sell, or otherwise use copies of restricted VIP Content after access ends.

9. Intellectual Property

Unless otherwise stated, the Website and its original content, including but not limited to:

• Original jewelry designs;
• Wire crochet designs;
• Tutorial videos;
• Instructional demonstrations;
• Instructional methods and presentation materials;
• Photographs;
• Graphics;
• Written instructions;
• Product descriptions;
• Branding; and
• Other original creative materials

are owned by, licensed to, or otherwise lawfully used by U Touch Technology Development Limited and are protected by applicable intellectual property laws.

Purchasing a physical product, tutorial, membership, subscription, or obtaining access to Digital Content does not transfer ownership of Michelle ML intellectual property to the purchaser.

Customers may use purchased tutorials for personal learning and may create their own finished handmade items in accordance with any specific license or usage terms accompanying the tutorial.

However, the tutorials themselves and their original instructional content may not be copied, recorded, reproduced, redistributed, resold, sublicensed, republished, uploaded, or otherwise made available to third parties without written permission from Michelle ML.

The use of artificial intelligence, generative AI, video editing, image processing, voice replacement, cropping, filtering, re-editing, or other technological processes does not, by itself, create authorization to use Michelle ML protected content.

Modification, transformation, editing, or processing of unauthorized copies of Michelle ML content—including through artificial intelligence or generative AI—does not grant permission from Michelle ML to reproduce, publish, distribute, sell, or otherwise exploit the underlying protected content.

Nothing in these Terms should be interpreted as transferring or waiving any intellectual property rights belonging to Michelle ML or U Touch Technology Development Limited.

10. Customer Accounts

Certain services may require customers to create or use an account.

Customers are responsible for maintaining the confidentiality of their login information and for activity conducted through their account.

• To remove, obscure, replace, or alter copyright notices, branding, watermarks, logos, or other source-identifying information from protected content for unauthorized publication or distribution; or
• To circumvent or attempt to circumvent technological measures, account restrictions, access controls, membership restrictions, or other measures used to protect restricted Digital Content.

Where we reasonably determine, based on available evidence, that these Terms have been materially violated, we may restrict, suspend, or terminate access to protected content or the relevant account, subject to applicable law and any mandatory consumer rights.

Where appropriate, Michelle ML may also take reasonable steps to protect its intellectual property rights, including requesting removal of unauthorized copies from platforms or services on which such content has been published.

14. Disclaimer and Limitation of Liability

To the extent permitted by applicable law, the Website, products, and services are provided subject to the terms, descriptions, and conditions stated on the Website.
